Warranty Policies

Engineering Services
Upon submitting a form to Comsearch requesting engineering services, you agree to engage the services of Comsearch to perform an engineering analysis based on data you provide. Comsearch will perform the analysis using its proprietary databases and methodologies, and the results will be returned to you on screen or via other acceptable means. Comsearch warrants that the analysis will be performed in a workmanlike manner in conformance with applicable industry standards and practices.

Comsearch shall re-perform any nonconforming services that result in erroneous results, employing all reasonable commercial practices, at no cost to you provided that such nonconforming services are brought to Comsearch’s attention in writing within three (3) business days from the date of the original transaction. You agree to pay Comsearch its customary and usual fees and charges to correct any errors that resulted in whole or in part from errors or omissions in information supplied by you.

YOU AGREE THAT YOUR SOLE REMEDY FOR ANY DEFECTS IN THE SERVICES OR ERRORS IN THE RESULTS SHALL BE RE-PERFORMANCE OF THE ANALYSIS AND REPLACEMENT OF THE RESULTS, OR, IN THE EVENT COMSEARCH DETERMINES THAT ERRORS CANNOT BE CORRECTED WITHIN A REASONABLE PERIOD OF TIME, A REFUND OF MONIES PAID FOR THE SERVICES. IN NO EVENT SHALL COMSEARCH’S TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE SERVICES. COMSEARCH WILL NOT BE RESPONSIBLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, AND YOU AGREE TO WAIVE ALL CLAIMS AGAINST COMSEARCH BASED ON THE COMPLETENESS OR ACCURACY OF THE ANALYSIS AND/ OR THE RESULTS. THIS WARRANTY IS THE SOLE AND COMPLETE WARRANTY WITH RESPECT TO THE SUBJECT MATTER HEREOF, AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Return/Refund policy for Comsearch Engineering Services
In the event that the results provided to you by Comsearch contain errors as a result of Comsearch’s failure to properly perform the analysis, and such error(s) is(are) brought to Comsearch’s attention in writing within three (3) business days from the provision of the services, then Comsearch will re-perform such services and replace results such that they will conform to reasonable industry standards. If Comsearch determines that it is unable to correct such defects within a reasonable period of time, then Comsearch will issue a refund or credit to equal to the amount paid for the nonconforming services.

Regulatory/Licensing Services
Comsearch will submit documentation and applications on behalf of the Customer to third parties for regulatory/licensing purposes. Comsearch does not warrant nor will be liable for errors and/or omissions by third parties. Fees paid on behalf of customer will not be refunded to the extent a refund is not obtained from any third party to which a fee was paid on behalf of the customer.

Data Products
Comsearch does not represent or warrant that the data products downloaded from Comsearch.com (the “Data”) are complete, accurate, and free from error, nor does Comsearch represent or warrant that errors are correctable. In the event that errors exist in the Data that materially affect the usefulness of the Data, customer shall notify Comsearch within three (3) business days from the provision of such Data. Comsearch’s liability, and customer’s sole and exclusive remedy, shall be limited to (1) correction of errors, (2) provision of a suitable replacement, or, (3) a refund of fees paid for the specific Data. Customer irrevocably gives up any right to obtain a refund for defective Data after three (3) calendar days have elapsed from the date of the completion of the online transaction (“Purchase Date”). However, Comsearch will make every effort in good faith to correct or replace defective Data provided notice of such defective Data is received within ninety (90) days of the Purchase Date.

Return/Refund Policy for Data Products Downloaded From Comsearch.com
Within three (3) business days of the Purchase Date, customer may request a refund should the Data be found defective.

To request a refund:

  1. Send an e-mail to customersupport@comsearch.com with the following information:
    • your full name
    • company name
    • order number
    • description of Data ordered
  2. After your request has been received, you will be sent a “Letter of Destruction” that requires the following information:
    • your name
    • address
    • confirmation of e-mail address
    • reason for return
    • signature

    You must deinstall the Data from your computer and any storage devices, as well as delete any backup copies. Once the product is fully deinstalled, complete and sign the Letter of Destruction and email it, along with a copy of the receipt of purchase, to customersupport@comsearch.com.

  3. After a completed Letter of Destruction and the receipt of purchase has been received, your refund will be processed.

YOU AGREE THAT YOUR SOLE REMEDY FOR ANY DEFECTS IN THE SERVICES OR ERRORS IN THE RESULTS SHALL BE RE-PERFORMANCE OF THE ANALYSIS AND REPLACEMENT OF THE RESULTS, OR, IN THE EVENT COMSEARCH DETERMINES THAT ERRORS CANNOT BE CORRECTED WITHIN A REASONABLE PERIOD OF TIME, A REFUND OF MONIES PAID FOR THE SERVICES. IN NO EVENT SHALL COMSEARCH’S TOTAL LIABILITY EXCEED THE AMOUNT PAID FOR THE SERVICES. COMSEARCH WILL NOT BE RESPONSIBLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, AND YOU AGREE TO WAIVE ALL CLAIMS AGAINST COMSEARCH BASED ON THE COMPLETENESS OR ACCURACY OF THE ANALYSIS AND/ OR THE RESULTS. THIS WARRANTY IS THE SOLE AND COMPLETE WARRANTY WITH RESPECT TO THE SUBJECT MATTER HEREOF, AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE.
